Full Tilt Poker is embroiled in yet another legal battle and the opponent this time, is already well known to legal team of the online card room, for it is one Cycalona Gowen.
In November 2008, “Clonie” Gowen attempted to sue Tiltware LLC, the software company associate with Full Tilt Poker, claiming that as reward for her role as part of “Team Full Tilt” she was promised 1% ownership of the company. She claimed that she received no tournament buy-ins or other financial compensation during her time working for Full Tilt in a promotional capacity, in which she played exclusively at Full Tilt and wore company logos at various tournaments, aside from her 1% ownership.
Gowen’s legal team claimed there was a verbal contract with Ray Bitar, co-founder of the company, regarding the ownership and that Howard Lederer, another co-founder, had offered her £250,000 in 2007, for her performance within the company. Gowen refused this, based on the assertion that her percentage ownership would be worth a lot more. Her team estimated that the 1% equated to around $40 million and as such, were seeking a similar amount due to breach of contract and other claims, including fraud.
The claims were dismissed, many with prejudice, meaning that no further legal action can be taken with regard to those claims. Surely an end to the matter? Not quite.
On January 8th 2010 however, Tiltware LLC filed a complaint of their own against Gowen, not seeking financial damages, but simply looking for a clear statement from her that she does not have the 1% ownership in Full Tilt that she claims. It is thought that Full Tilt are looking for the court to rule against Gowen without a trial, which would help them in similar cases, including that of Jason Newitt, who is also locking horns in court with Full Tilt. Newitt claimed that he was unfairly dismissed in September 2009, after he accidentally leaked embarrassing internal correspondence.
And that’s not where the courtroom drama ends. In October 2009, Lary Kennedy and Greg Omotoy went to court after Full Tilt confiscated $80,000 from them, with accusations of multi-accounting and use of illegal poker “bots”. Kennedy maintained her innocence and claimed she had video proof that she wasn’t using a bot, claims ignored by Full Tilt. She also alleged that Full Tilt themselves used bots and that members of “Team Full Tilt” played with company earnings, which is tantamount to playing against the house, potentially breaching business code violations and falsely advertising.
It seems that the Full Tilt lawyers are very busy people! The cases continues…
